Vero police denied arrest warrant in bar shooting

VERO BEACH – The Vero Beach Police Department was denied an arrest warrant in the case of the March shooting at The Grove.

Police spokeswoman Ofc. Anna Carden released a statement from the department outlining the work the investigators had done but that, in the end, the State Attorney’s Office denied the Vero Beach Police Department’s request for an arrest warrant for a suspect.

That suspect was not named in the statement provided.

According to Ofc. Carden, the Detective Division’s investigation had been ongoing since the shooting on March 31, following each lead that was uncovered. The division completed a “detailed 29-page complaint affidavit” that called for the arrest of a suspect.

Ofc. Carden did not provide why the State Attorney’s Office denied the agency’s arrest warrant.

“All active investigative leads have been exhausted at this time,” Ofc. Carden wrote in the statement. “However this investigation will remain active as the presentation of additional evidence and/or witnesses could substantiate a finding a probable cause for the arrest of the suspect.”

Vero Beach Police responded to The Grove, 2115 14th Ave. in downtown Vero, just before 2 a.m. March 31. Officers located one gunshot victim – The Grove owner Andy Capak. Eight witnesses were interviewed but their “witness statements conflicted substantially with each other as well as with statements given by Mr. Capak,” according to the statement.

Capak was interviewed on three separate occasions and was unable to identify the suspect who shot him, the statement says.
