Felon arrested for firing shots in his Sebastian yard

SEBASTIAN — Complaints of shots fired from a Sebastian residence led to the arrest of a convicted felon for possessing and firing a weapon under the influence of alcohol.

David Clark, 32, of the 5700 block of North Tropicana Drive in Sebastian, is being held in lieu of $111,000 after police responded to his residence, heard a shot fired, and witnessed Clark standing on his back porch holding a handgun, according to the arrest affidavit.

Authorities found several 40 caliber casings in the yard and what are known as “dig marks” indicative of shots fired into the grass, according to the official report.

The defendant is facing charges including possession of a firearm by a convicted felon, misdemeanor possession or use of firearm while under the influence of alcohol or chemicals, and misdemeanor resist arrest without violence.

A subject identified as James Herndon was seen with Clark on the porch at the time of the arrest, but fled when police ordered him to the ground.

Herndon was arrested for resisting arrest without violence and was released on $500 bond.
