INDIAN RIVER COUNTY — An Indian River County man faces two charges of Felony Aggravated Assault with a Deadly Weapon after allegedly pointing a revolver at neighborhood children he believed were attempting to steal his dog.
Tobias Marshal McKemie, 34, of the 1400 block of 21st Avenue Southwest in Vero Beach was arrested on Saturday evening when police were called to an altercation at his home.
According to the arrest report, multiple juveniles told police they were in McKemie’s yard when McKemie “came home and started yelling and cursing at the children in the roadway.”
The report continued, “[McKemie] then drew his hand out of his pocket and manually possessed a gun,” and yelled that the next person that entered his yard would get “popped.”
Police found a revolver in the front pocket of McKemie’s pants.
McKemie told police he believed the children were being “disrespectful” and confirmed the juveniles’ allegations regarding the gun and his threats.
According to the arrest affidavit, McKemie’s son told police he invited the group of kids to the backyard and his daughter said she only assumed a theft was taking place.
Police determined the allegation of theft to be unfounded, the report states.
McKemie was released Sunday afternoon on $1,000 bond.
