INDIAN RIVER COUNTY — A 2007 dispute over the placement of Sea Turtle Lane in the Surf Colony Subdivision in Vero Beach resulted in naming Indian River County as a party to a lawsuit, according to Deputy County Attorney William DeBraal.
The lawsuit consisted of an adjoining land owner suing the Surf Colony Subdivision over the placement of Sea Turtle Lane, where the plaintiff claimed “the County may have an interest in Sea Turtle Lane by way of the plat dedication,” according to official documentation.
According to the background information, “the County has never asserted ownership of the right-of-way nor has it ever maintained or repaired Sea Turtle Lane.”
Commissioners voted 4-0, excluding Commissioner Davis who was not present at the meeting, to approve the County Attorney’s recommendation to officially denounce any interest in Sea Turtle Lane in order to facilitate settlement of the lawsuit.
